Subscription Terms
Duration: The subscription will be valid for a period of 12 months from the date of sign-up, unless otherwise agreed upon by both parties.
Price: The price for the subscription will be as agreed between the parties and payable in full at the beginning of each subscription period. Prices may vary based on service packages provided by Gogency.
Payment: Payment can be made through credit card, PayPal, bank transfer, or any other payment method offered by Gogency.
Renewal: The subscription will automatically renew for additional 12-month periods unless the customer cancels the subscription at least 30 days before the end of the subscription period.
Service Level Agreement (SLA)
Response Time: Gogency will respond to customer queries and support requests within 24 hours of receipt, Monday to Friday.
Support Availability: Support services will be available from Monday to Friday, between 11:00 AM and 8:00 PM local time, or as otherwise agreed based on the subscription tier.
Payment: Payment can be made through credit card, PayPal, bank transfer, or any other payment method offered by Gogency.
Service Uptime: Gogency will use commercially reasonable efforts to ensure 99% service uptime per month.
Intellectual Property Rights
Ownership: All intellectual property rights in the software, website, and other materials created or provided by Gogency remain the property of Gogency, unless otherwise agreed in writing.
License: Gogency grants the customer a non-exclusive, non-transferable license to use the software and platform for the purposes of the subscription.
Confidentiality Protection: Both Gogency and the customer will take reasonable measures to protect each other’s confidential information.
Disclosure: Non-Neither party shall disclose confidential information to third parties without prior written consent from the other party.
Limitations of Liability
Indirect Losses: Gogency shall not be liable for any indirect, special, or consequential losses arising from the services provided.
Maximum Liability: Gogency's total liability for damages or losses shall not exceed the total amount paid by the customer under the subscription.
Data Protection and Privacy
Collection and Use: Gogency will collect and use personal data in accordance with applicable data protection laws and policies.
Third Parties: Gogency may share personal data with third parties only for service delivery purposes, in compliance with relevant regulations.
Termination
Termination by Customer: The customer may terminate the subscription by giving Gogency written notice at least 30 days before the end of the subscription period.
Termination by Gogency: Gogency may terminate the subscription immediately if the customer breaches any terms of the agreement.
Governing Law
This agreement will be governed by and construed in accordance with the laws of the jurisdiction where Gogency is located. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
